Welcome to Inaivaa. These Terms of Service ("Terms") govern your use of our website, mobile applications, in-store services, and online delivery platform operated by Kuberah GmbH. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

- "Inaivaa" refers to Inaivaa operated by Kuberah GmbH
- "Services" includes our physical store, website, mobile app, and delivery services
- "Products" refers to all goods available for purchase
- "Customer" or "You" refers to any person using our services
- "Bazaa" refers to our online delivery platform and vendor network
3. Account Registration
To access certain features, you may need to create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use
- Be responsible for all activities under your account
- Be at least 18 years of age to create an account
4. Orders and Payments
4.1 Placing Orders
Orders can be placed in-store, online via our website, through Bazaa platform, or by phone. All orders are subject to product availability and acceptance by Inaivaa.
4.2 Pricing
All prices are in Euros and include applicable VAT unless stated otherwise. We reserve the right to change prices at any time. Pricing errors will be corrected, and you will be notified before order fulfillment.
4.3 Payment
We accept major credit cards, PayPal, Klarna, and cash on delivery (where available). Payment is required at the time of order placement for online orders.
4.4 Order Confirmation
You will receive an order confirmation via email. This does not constitute acceptance of your order. We reserve the right to refuse or cancel orders at our discretion.
5. Delivery Services
5.1 Delivery Areas
We deliver throughout Germany via our Bazaa platform. Delivery fees and minimum order requirements may apply depending on your location.
5.2 Delivery Times
Estimated delivery times are provided at checkout. While we strive to meet these times, they are estimates only and not guaranteed. We are not liable for delays beyond our control.
5.3 Failed Deliveries
If delivery cannot be completed due to incorrect address information or customer unavailability, additional delivery charges may apply for re-delivery attempts.
6. Returns and Refunds
6.1 Return Policy
Non-perishable items may be returned within 7 days if unopened and in original packaging. Perishable food items cannot be returned for hygiene reasons unless there is a manufacturing defect.
6.2 Damaged or Defective Products
If you receive damaged or defective products, please contact us within 24 hours of delivery with photographic evidence. We will arrange a replacement or refund.
6.3 Refund Processing
Approved refunds will be processed within 5-10 business days to your original payment method.
7. Inaivaa VIP Loyalty Program
Our loyalty program offers exclusive benefits to members. Program terms, point values, and rewards are subject to change. Points have no cash value and cannot be transferred. We reserve the right to terminate accounts for fraudulent activity.
8. Help to Study Programme
Eligible students aged 18+ with valid student ID can receive a 5% discount. The programme requires registration and ID verification. Discounts cannot be combined with other offers unless explicitly stated.
9. Prohibited Uses
You may not use our services to:
- Violate any laws or regulations
- Engage in fraudulent activities
- Resell products for commercial purposes without authorization
- Use automated systems to scrape data or content
- Interfere with the proper functioning of our services
- Impersonate others or provide false information
10. Intellectual Property
All content, trademarks, logos, and intellectual property on our website and services are owned by Kuberah GmbH or licensed to us. You may not use, copy, or distribute our content without written permission.
11. Limitation of Liability
To the maximum extent permitted by law, Inaivaa shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the specific product or service giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Inaivaa, Kuberah GmbH, and its affiliates from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of our services.
13. Termination
We reserve the right to suspend or terminate your account and access to our services at any time, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.
14. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Dortmund, Germany.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified Terms.
